PRIVACY POLICY

1. INTRODUCTION

1.1. PURPOSE OF POLICY. Power Engineering Construction Company  (“us,” “we,” or “Company”) is committed to respecting the privacy rights of its customers, visitors, and other users of the Company Website and services (together, the “Site”). We created this Privacy Policy (this “Policy”) to give you information about our collection, use, and disclosure of information about you, as well as your rights regarding that information. This Policy is not applicable to any other websites that you may be able to access from the Site, each of which may have data collection and use practices and policies that differ materially from this Policy.

PLEASE NOTE: We are a general audience site, and do not direct any of our content specifically at children under 13 years of age. We understand and are committed to respecting the sensitive nature of children’s privacy online. If we learn or have reason to suspect that a Site user is under age 13, we will promptly delete any personal information in that user’s account if such account exists.

2.1. WHAT INFORMATION DOES THE COMPANY COLLECT?

(a) INFORMATION YOU PROVIDE. In operating the Site, Company may include registration, online surveys, and other online forms that ask users to provide their names, email addresses, and other contact information, as well as the categories of information listed at Section 5.3.1. Depending on your use of the Site, we may also request financial data (such as your account or credit card number for purchases) and demographic data (such as your zip code, age, and income). If you communicate with us by email, post messages to any of our chat groups, bulletin boards, or forums, or otherwise complete online forms, surveys, or contest entries, any information provided in those communications will be collected from you.

(b) AUTOMATIC COLLECTION. When you visit the Site, our servers automatically recognize (1) visitors’ domain names; (2) IP addresses (the number assigned to computers on the Internet); (3) device information; and (4) location data. This “traffic data” may be used for marketing purposes or for improving the services we offer, as explained in more detail below.

(c) TRACKING TECHNOLOGIES. We use “cookies” and other tracking technologies that allow us to store a small piece of data on your computer about your visit to the Site. Cookies help us learn which areas of the Site are useful and which areas need improvement. You can choose whether to accept cookies by changing the settings on your browser. However, if you choose to disable this function, your experience at the Site may be diminished and some features may not work as they were intended. (d) INFORMATION FROM OTHER SOURCES. Except as provided for herein, the Company does not receive information from any other sources such as advertising networks, internet service providers, data analytic providers, government entities, operating systems and platforms, social networks, and data brokers. The Company does receive information from Google Analytics for site performance analysis.

3. USE AND SHARING OF INFORMATION

3.1. WHAT DOES COMPANY DO WITH COLLECTED INFORMATION?

(a) OPERATING OUR SITE AND PERFORMING SERVICES. We use your personal information to verify your identity, to check your qualifications , or to follow up with transactions initiated on the Site. We may also use your contact information to inform you of any changes to the Site, or to send you additional information about Company. If you give your permission during the account registration process, we may share your contact information with our business partners or other companies so that they may send you promotional materials. We use financial information to verify your qualifications for certain products or services and to process payments. We use demographic data to customize and tailor your experience on the Site, displaying content that we think you might be interested in and according to your preferences.

(b) TRAFFIC DATA. We use traffic data to analyze our Site traffic, but we do not examine this information for individually identifying information. In addition, we may use IP addresses to help diagnose problems with our server, to administer the Site, or to display the content according to your preferences. Traffic and transaction information may also be shared with business partners and advertisers on an aggregate basis.

Promotions or advertisements that may be displayed on our Site may contain cookies. We do not have access to or control over information collected by outside advertisers on our site.

(d) DISCLOSURE OF PERSONAL INFORMATION. We may disclose personal information that you provide via the Site to the following third parties:

• Our subsidiaries and affiliates;

• Joint venture or marketing partners who may want to send you information about their products or services, unless you have specifically requested that we not share your information for this purpose; and

• Contractors, vendors, and service providers we use to support our business and the Site. These support partners have all agreed to uphold the same standards of security and confidentiality that we provide to you under this Policy, and they have agreed to only use your information to carry out their specific business obligations to Company.

We may also disclose personal information that you provide via the Site in the event of a merger, acquisition, or any form of sale of some or all of our assets, in which case personal information we collect via the Site will be among the assets transferred to the buyer. Further, we may disclose your personal information to third parties to

• Enforce or apply our terms of use and other agreements; and

• Protect the rights, property, or safety of our business, our clients, customers, employees, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection, information security, and other related matters.

4. USER CHOICES REGARDING COLLECTION, USE, AND DISTRIBUTION OF INFORMATION.

4.1 ACCURACY OF PERSONAL INFORMATION WE MAY COLLECT. We do not maintain personal profiles of anyone who visits our website. We do maintain the Personal Information that you may upload to Company including but not limited to resumes or Vendor Information at our Vendor portal, and you may submit a request via email at pec@powerengconstruction.com to request copies of any and all information that you have provided to us.

We will provide you with any and all information you have uploaded to Company for your review. We will confirm receipt of your request within 10 days.  We may require specific information from you to help us verify your identity and process your request. If we are unable to verify your identity, we may deny your request for information.

On receipt of such information from us, you may: (a) review and update your Personal Information that we have already collected; (b) choose whether you wish us to send you information about our company or promotional material from some of our partners; and (c) choose whether you wish for us to share your Personal Information with third parties.

4.2. LOST OR STOLEN INFORMATION. You must promptly notify us if any Personal Information you have provided to us, including but not limited to any credit card, user name, or password is lost, stolen, or used without permission. In such an event, we will remove such Personal Information and update our records accordingly.

4.3 COMMUNICATIONS.

• You can opt-out of emails from us by clicking on the unsubscribe link in each message, or emailing us with UNSUBSCRIBE in the subject field of the email.

5. FOR RESIDENTS OF CALIFORNIA

5.1 SHINE THE LIGHT.

Under California’s “Shine the Light” law, California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from the recipient company, once each calendar year, information about the customer information the recipient company  shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately preceding calendar year.

Company does not share any Personal Information that an individual may provide to it but if you have any concerns whatsoever you are free to contact the Company as indicated here.

To obtain this information, please send an email message to  pec@powerengconstruction.com with “Request for Privacy Information” in the subject line and in the body of your message. We will provide in response the requested information to you at your email address to the extent we have it.

Please be aware that not all information sharing is covered by the “Shine the Light” requirements and only required information will be included in our response.

5.2 ERASER BUTTON

Under California’s “Eraser Button” law, California residents under age 18 who have registered to use the Site may request removal of content they have posted. To make a request, please send an email message to pec@powerengconstruction.com with “Request to Remove Content” in the subject line and in the body of your message. We will provide in response the requested information to you at your email address to the extent we have it.

5.3 The California Consumer Privacy Act as amended by the California Privacy Rights Act  (together the “CPRA”) provides additional rights to residents of California regarding our information collection and use practices.

Non-Precise Geolocation Data: We use Non-Precise Geolocation Data to enable use of our site, to communicate with you as necessary,  to understand how our users interact with our Site, to improve our site and in the case of our Vendor Portal, to ascertain if information you may submit is appropriate for our purposes in performing future work we may hire you for, or if it is responsive to our requested needs. We may also use this information to determine if you are an international visitor such that we need to advise you of any European Union (“EU”) Privacy Rights. This site is directed at consumers in the United States only and we do not direct our services to residents of the EU. If we determine that you are an International Visitor from the European Union, we may need to notify you of specific privacy rights that may apply to you in that capacity.

Professional or Employment-related Information: We use Professional or Employment-related Information to enable use of our site, to communicate with you as necessary regarding future employment opportunities,  to understand how our users interact with our Site, to improve our site and in the case of our Vendor Portal, to ascertain if information you may submit is appropriate for our purposes in performing future work we may hire you for, or if it is responsive to our requested needs. We also solicit interest in career opportunities and employment opportunities, and encourage users of our site to submit information to us such as resumes, educational background or information, or other employment background information about career opportunities with our Company for review by our human resources department for pre-employment review. We use that information to determine if you meet the criteria for further employment with us.

Educational Information: We solicit interest in career opportunities and employment opportunities, and encourage users of our site to submit information to us such as resumes, educational background or information, or other employment background information about career opportunities with our Company for review by our human resources department as part of our pre-employment review and in the case of our Vendor Portal, to ascertain if information you may submit is appropriate for our purposes in performing future work we may hire you for, or if it is responsive to our requested needs. We use that information to determine if you meet the criteria for further employment with us.

Inferences: We use Inferences to enable use of our site, to communicate with you as necessary,  to understand how our users interact with our Site, to improve our site and in the case of our Vendor Portal, to ascertain if our inferences from information you may submit are  appropriate for our purposes in performing future work we may hire you for, or if it is responsive to our requested needs.

We do not disclose these categories of Personal Information to any other person or business outside of Company and only use such information for our own business purposes within Company in accordance with the CPRA.

5.3.2 SENSITIVE PERSONAL INFORMATION

Except as set forth herein. Company does not collect, sell or share  Sensitive Personal Information from any user of this website other than for limited business purposes identified in the CPRA. We are signatories to different collective bargaining agreements; as such we do collect information from submissions made through our Vendor Portal regarding whether or not potential applicants are also signatories to collective bargaining agreements in deciding whether we can use such potential applicants in our business. We are otherwise unable to use non-union vendors in our business without violating the terms and conditions of the different collective bargaining agreements we are otherwise bound to.  Additionally, such information is otherwise publicly available and may not constitute Sensitive Personal Information or Personal Information. We otherwise do not collect, sell or share Sensitive Personal Information.

5.3.3 RETENTION

We generally store Personal Information as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, as we determine is necessary for business records, and as required under applicable law.

5.3.4 RIGHTS OF CALIFORNIA RESIDENTS

A. Right to Know

You have the right to know certain details about our data practices. In particular, you may request the following from us:

• The categories of personal information we have collected about you;

• The categories of sources from which the personal information was collected;

• The categories of personal information about you we disclosed for a business purpose or sold or shared;

• The categories of third parties to whom the personal information was disclosed for a business purpose or sold or shared;

To exercise the Right to Know, please submit a request  at pec@powerengconstruction.com. In the request, please specify which right you are seeking to exercise and the scope of the request. We will confirm receipt of your request within 10 days. We may require specific information from you to help us verify your identity and process your request. If we are unable to verify your identity, we may deny your requests to know.

B. Right to Correct or Delete

You have the right to request that we correct or delete the personal information we have collected from you.  To exercise the Right to Delete, please submit a request to pec@powerengconstruction.com. We will confirm receipt of your request within 10 days. We may require specific information from you to help us verify your identity and process your request. If we are unable to verify your identity, we may deny your request to delete any requested information. If we deny your request, we will explain the reason why in our response.

C. Right to Opt-Out of Sales or Shares

Customers, visitors and users  have the right under California law to tell companies  not to sell or share their  information at any time.  Special rules apply to those customers, visitors and other users under the age of 16 years old. However, Company does not sell or share any Personal Information or Sensitive Personal Information from such customers, visitors and other users to any third party and only uses these items for Company’s valid business purposes under the CPRA.

If for any reason Company changes its policy, you are a California resident and we know you are under 16 years of age, we will not sell your personal information unless (i) you are 13 years of age or more and have provided opt-in consent and confirmed that choice, or (ii) you are under 13 years of age and your parent or guardian has provided affirmative authorization of that sale.  If you or your parent or guardian has provided opt-in consent, you can change your mind at any time by  submitting a request at pec@powerengconstruction.com advising us of your decision to opt-out of any sale of your personal information.

If you feel that we have sold or shared your information against our Company policy or your express wishes, please submit a request  at pec@powerengconstruction.com. In the request, please tell us of your concerns.  We will confirm receipt of your request within 10 days. We may require specific information from you to help us verify your identity and process your request. If we are unable to verify your identity, we may deny your requests.

D. Right to Limited the Use of Sensitive Personal Information

You have the right to tell us to limit the use or disclosure of your Sensitive Personal Information at any time.  To exercise this right, please submit a request  at pec@powerengconstruction.com. In the request, please tell us how you wish us to limit the use or disclosure of your information. We will confirm receipt of your request within 10 days. We may require specific information from you to help us verify your identity and process your request. If we are unable to verify your identity, we may deny your requests.

You can designate an authorized agent to submit requests on your behalf. However, we will require written proof of the agent’s permission to do so and verify your identity directly.

We do not offer any financial incentives for users of our website. We do not disclose any Personal Information or Sensitive Personal Information about any customers, visitors or other users except in compliance with the provision of the CPRA. We will delete any Personal Information or Sensitive Personal Information as provided for in this privacy policy. We do not sell any Personal Information or Sensitive Personal Information. We do not offer financial incentives of any kind for performing these acts on behalf of customers, visitors and other users.

H. Data Reporting Requirements

Pursuant to California Consumer Privacy Act Regulation section 7102, a business that knows or reasonably should know that it, alone or in combination, buys, receives for the business’s commercial purposes, sells, shares, or otherwise makes available for commercial purposes the personal information of 10,000,000 or more consumers in a calendar year must compile and disclose certain specific information by way of a link embedded in its privacy policy.  Company does not meet the requirements of these regulations, which do not apply to Company at this time.  This provision may be updated in the future when necessary.

The Site has security measures in place designed to prevent the loss, misuse, and alteration of the information that we obtain from you, but we make no assurances about our ability to prevent any such loss, misuse, to you or to any third party arising out of any such loss, misuse, or alteration.
